Young girl sentenced in 2019 to 13 years in prison for a miscarriage — released
On 20 December 2022, Aurelia García, a young indigenous woman from the state of Guerrero, who had been sentenced to 13 years in prison after suffering a miscarriage in 2019, was released. GIRE (Grupo de Informacion en Reproduccion Elegida – GIRE) celebrates and congratulates all the Guerrerense local collectives that accompanied Aurelia in her road to justice and freedom!
Aurelia is the first woman to obtain her freedom after the decriminalisation of abortion in Guerrero on 17 May 2022. This ruling set an important precedent for all women deprived of liberty for any crime charged as abortion-related. It is further strengthened by the 2021 Supreme Court ruling declaring the unconstitutionality of the absolute criminalisation of abortion.
Aurelia’s case is testament to the ways women are criminalised for having an abortion, the prejudices they face and the constant violation of their human rights. Similarly, activists and defenders from Guerrero added that the local authorities have yet to comply with the measures of reparation and non-repetition.
